The 1994 Dietary Supplement Health and Education Act (DSHEA) defines "dietary supplements" as including herbal ingredients and outlines what types of health-benefit claims manufacturers can make about them. To make a claim about an herbal dietary supplement, the manufacturer must have substantiation for the claim and must notify the FDA of the claim being made within the first 30 days of marketing the supplement. If a "statement of nutritional support" is made, the following notice must be part of the product's label: "This statement has not been evaluated by the FDA.This product is not intended to diagnose, treat, cure or prevent any disease."
